Covenant Violation Procedures

When a possible covenant violation is reported to the HOA, here’s the step-by-step process we follow:

  1.  Notice of Non-Compliance: Reported possible covenant violations are investigated by the HOA. If a property is found to be in violation, a Notice of Violation is sent via Certified Mail with a Return Receipt Requested and by First-Class U.S. Postal Service (USPS) mail to the property owner. The letter identifies the violation and gives the owner 30 days in which to correct or “cure” the violation. Homeowners are asked to cure the violation and provide photographic evidence or other appropriate evidence of their cure by emailing hoacovenants@gmail.com or by USPS to the HOA Business Office at 5896 E. Geddes Ave.
  2. After 30 days, the property is inspected again. If the violation has not been satisfactorily cured, a fine of $50 is imposed. The owner is offered the right to a hearing before the Board of Directors. Instructions on how to request a hearing are included in the letter or may be found on this website.
  3. If a homeowner fails to respond to the letter, cure the violation or request a hearing, the HOA will inspect the property again after 60 days of the initial Notice of Non-Compliance (the second cure period). If the HOA determines the alleged violation does violate the community Governing Documents, it will imposed a second fine of $200.
  4. Failure to cure the violation within 90 days of the initial Notice of Violation (third cure period) will result in a fine of $250, a non-compliance lien being filed with Arapahoe County, suspension of Pool, Tennis and HOA voting privileges, and referral to legal counsel for enforcement. The HOA may continue to assess fines on a weekly basis at the conclusion of the third cure period.
