To appeal a denial of your ACC application request, you must submit an email within 14 days of the decision to homesteadacc@gmail.com with the subject line: Request for Appeal. The body of your email must include your full name, address, and phone number. The email should explain why you disagree with the ACC decision. Failure to follow these instructions may result in a waiver of an appeal. Please add homesteadacc@gmail.com to your contacts or check junk/spam folders.
The ACC does not require that you appear if you think that your email provides sufficient evidence of your position. The ACC will render a final decision and you will receive a written response after the meeting. Should you choose to appear, you will not get a decision during the meeting.
If your denial is upheld by the ACC, you may choose to further appeal it to the Homestead in the Willows Board of Directors. If so, you must email your written appeal within 14 days of the decision to homesteadacc@gmail.com with the subject line: Request for BOD Appeal. You will be contacted with the date and time to appear for the hearing.
All hearings will be held at the HOA Business Office located at 5896 E. Geddes Ave.or via Zoom call. Please be on time for your hearing, it will start promptly at the time provided to you. There will be two current members of the Board of Directors present and you will have ten minutes to state your position. You may bring witnesses and evidence to support your case if necessary.
You must be courteous and conduct yourself professionally. Failure to do so may result in a waiver of your appeal and you may be asked to leave. Please keep in mind that these are your neighbors who are volunteering their time to maintain the aesthetic of the neighborhood.
A decision will not be overturned if the only argument is that you disagree with the ACC. You must demonstrate that the ACC decision is in error or unfair under specific circumstances that apply to you or your situation.
